Terms & Conditions

In these terms and conditions:-

  • a) Any reference to “we” “our”, “us” or the Supplier, is a reference to the O'Reilly's Firearms
  • b) Any reference to “you” “your”, or the Customer is a reference to you as a Customer of the O'Reilly's Firearms purchasing goods via the Website shop.oreillysfirearms.com.au
  • c) Any reference to the Website is to the site shop.oreillysfirearms.com.au
  • d) Any reference to products or goods refers to goods purchased or made available for sale on the Website
  • e) A State or Territory means a State or Territory of Australia


  • 1a. Prices shown are subject to change without notice.
  • 1b. The placement of an order via the website or the receipt of payment in respect of that order does not constitute acceptance of that order by the Supplier. The Supplier will be deemed to have accepted that order only once the goods are dispatched. Alternatively, the Supplier may cancel or decline any order placed via the Website due to the unavailability of stock, pricing error or for any other reason, and will issue a refund in such an event if payment has been received by the Supplier.
  • 1c. All prices are shown in Australian dollars.
  • 1d. All prices include GST.
  • 1e. By using this site or by placing any order, you warrant that:-
  • (i) you are at least eighteen years of age; and
  • (ii) you are, if ordering products for your own personal usage, an Australian citizen or permanent resident; and
  • (iii) you reside or intend to reside in Australia and intend to collect any products purchased via this Website in Australia; and
  • (iv) you hold, and will continue to hold at the time of collection and possession of any products ordered by this site, the appropriate firearms licence and/or acquisition permit; and
  • (v) you will not use any product ordered or obtained from this site for any illegal or improper purpose.


  • 2a. All Freight or Postage is payable by the customer. Prices for products do not include freight except where expressly indicated.
  • 2b. Quotations for freight are provided as a convenience, including any instance where the cost of shipping is represented as being “free” or at zero cost. The seller reserves the right to notify buyer of actual cost of freight and adjust sell price by mutual consent or refuse sale at the seller’s discretion.
  • 2c. Freight quotes are for Australia only unless otherwise stated.
  • 2d. Deliveries will be made by a carrier of our choice to the address stipulated in the order.
  • 2e. You must ensure that someone is present to accept delivery. Anyone at the delivery address who receives the goods shall be presumed to be authorised by you to receive the goods on your behalf.
  • 2f. We may request that the recipient of the goods provides satisfactory proof of age. We may refuse delivery if satisfactory proof of age is not provided or if the recipient is not able to demonstrate that they are eighteen years or older.
  • 2g. The Supplier is not responsible for any damage to products caused by a freight handler and any such damage is the responsibility of the freight handler. We recommend that customers obtain insurance in relation to any items to be sent by freight and we endeavour to provide that option to customers when ordering where such an option is available.


  • 3a. You may cancel your order at any time before the order is dispatched and receive a full refund.
  • 3b. Once your order has been dispatched order cancellation will incur all freight charges.


  • 4a. Under no circumstances will the Supplier deliver licensed goods to private addresses. All customers will be required to collect their purchased goods from the physical address of the Supplier, subject to paragraphs 4b and 4c, below.
  • 4b. Subject to the Supplier’s unfettered discretion, the Customer may request to collect their goods from the physical address of another lawfully operating retail firearms dealer in Australia of the Customer’s election (herein called the “alternative dealer”). In such an instance the Customer shall be liable for the Supplier’s costs of transporting the goods to the alternative dealer and to any costs or charges levied by the alternative dealer in relation to the goods and the collection thereof. The Customer shall also be responsible for making any necessary arrangements for the collection of the goods from the alternative dealer. The goods shall be at the Customer’s risk at all times after they have left the Supplier’s possession, including whilst they are in the possession of any freight handler and/or any alternative dealer, and the Supplier shall not be liable for any loss, damage or forfeiture thereafter or any inability or delay in the Customer’s ability to collect the goods from the alternative dealer. It is the Customer’s responsibility to insure the goods against any loss after they have left the Supplier’s possession.
  • 4c. Subject to the Supplier’s unfettered discretion, customers in Queensland who do not reside within 50 kilometres of any dealer that appears in the Supplier’s list may request that their licensed goods be made available for collection from a police station in Queensland. The goods shall be at the Customer’s risk at all times after they have left the Supplier’s possession, including whilst they are in the possession of any freight handler and/or the Queensland Police Service or any other third party. It is the Customer’s responsibility to comply with any requirement of the Queensland Police Service regarding collection of those goods, and the Supplier accepts no liability for loss, damage or forfeiture to the goods that may occur whilst they are in the possession of the Queensland Police Service. It is the Customer’s responsibility to insure the goods against any loss after they have left the Supplier’s possession.
  • 4d. The customer will be notified once licensed goods are available for collection from the Supplier. Customers must ensure that they bring with them any necessary firearms licences, permits to acquire and/or proofs of identity that the Supplier or that the Collection Point may reasonably require or that may be legally required according to the laws of the relevant State in order to collect their licensed goods.
  • 4e. Customers must collect their licensed goods in person from the Supplier, unless the Supplier agrees to accept the Customer’s authorisation to allow collection by the Customer’s agent, which the Supplier may refuse or approve only conditionally according to its unfettered discretion. The collection of goods by an agent will only be allowed by the Supplier when such collection is permissible according to the laws of the relevant State or Territory. In making any such request, the Customer releases and indemnifies the Supplier for any loss or damage caused by the agent either in relation to the purchased goods or otherwise. Any agent of a customer must possess any requisite firearms licence or permit and satisfy all the requirements of this document as if they were a customer collecting licensed goods.
  • 4f. Notwithstanding any provision of this document, either the Supplier or the Collection Point may postpone or refuse to allow collection of licensed goods by a customer or agent of a customer for any reason, including but not limited to a customer being under the influence of alcohol or drugs, being violent, reckless or disruptive or engaging or indicating a willingness to engage in illegal behaviour, not possessing a drivers’ licence where appropriate, not possessing the requisite firearms licence or permit or not possessing adequate facilities for securing purchased goods during transit.
  • 4g. Notwithstanding any other provision of this Agreement, the Customer hereby releases indemnifies the Supplier from any loss, damage or bodily injury or death resulting from the use or misuse of the purchased goods once the Customer has taken possession of the licensed goods.
  • 4h. The offer of payment or payment in full for firearms, ammunition, or any licenced product is not to be considered an "Acquisition" of that product.
  • 4i. All licensed goods on our website are approved for sale to appropriately licensed hunting and sporting goods users in Australia only. They may not be re-exported or transferred to any other country outside of Australia.


  • 5a. Quantities shown on our website are to be considered approximate only and do not guarantee availability of the product.
  • 5b. We cannot guarantee the availability for purchase of any product at any time either now or in the future nor can we guarantee the service life of any product or that technical service, spare parts or manufacturer support will be available at any time or for any given length of time in relation to any product.
  • 5c. We reserve the right to limit or cancel orders of any given quantity of items. In the event that a customer has completed an order via the website and the Supplier wishes to reduce the number of products ordered, the customer will be given the option of proceeding with the reduced order or a full refund. In the event of a cancellation for which the Customer has completed payment, the full amount of the relevant payment will be refunded to the Customer.
  • 5d. We reserve the right to refuse to supply commercial quantities of any given product, to refuse service to any individual or group that we consider to be a commercial or trading entity or reseller or retailer, and to limit or refuse service to any individual, group or geographic location or region.


  • Stock images should be considered as indicative only. The actual item may differ from the image depicted on the website. The colours of products may vary depending on the display settings of your computer or device and the lighting employed in the photography of the product as it appears in the stock image. Such variations will not constitute any defect in the product.


  • 7a. Please choose carefully. We do not normally give refunds if you simply change your mind or make a wrong decision.
  • 7b.Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
  • 7c. In the event that the Supplier breaches or is found liable for any breach of a warranty according to the Australian Consumer Law its liability shall be limited at its option, to any one or more of the following:
    • (i) In the case of goods: replacement of the goods or the supply of equivalent goods; repair of the goods; payment of the cost of replacing the goods or acquiring goods; or payment of the cost of having the goods repaired; and
    • (ii) In the case of services: to either supplying the services again or payment of the cost of having the services supplied again.
  • 7d.All products sold are covered by a manufacturer’s warranty, which is distinct from and in addition to any rights that you may have under the Australian Consumer Law, and which is generally 12 months from the date of purchase unless otherwise stated.

    To expedite the process please have your order number on hand when making your claim. You will find the order number on the emails you received from us when you ordered the product/products.
  • 7f. Please contact us before returning goods for refund, exchange, repair or credit. Goods will not be accepted for refund, exchange, repair or credit without prior arrangement.
  • 7g. If the products are found to be faulty, or to have been wrongly described, or are different to the product purchased on the website or don’t perform as advertised, the Customer will be offered the choice of a refund, exchange, repair or store credit, and will not be required to pay for any freight costs associated with the return of the goods. If, however, the goods are found not to be faulty, the Customer will be required to pay the Supplier for the freight costs prior to the goods being returned to the Customer.
  • 7h. Refunds will be credited back to the credit card on which the goods where purchased.
  • 7i. A product will not be considered faulty if :-
    • a) it has suffered physical damage due to an unintended use; or
    • b) liquid or water ingress where such products would not reasonably be expected to be waterproof; or
    • c) it has been damaged due to fire or extreme temperature abuse or electrical surge; or
    • d) It as been inappropriately modified or tampered with; or
    • e) It as been used contrary to the manufacturer’s instructions.
  • 7j. We will not accept freight-on charges for goods returned for any purpose without prior arrangement.
  • 7k. You can choose between a refund, exchange or store credit where goods are faulty, have been wrongly described, are different to the product purchased on the website or don’t perform as advertised.


  • 8a. We may make adjustments, improvements or changes to our website, its content, or to any of the products, at any time and without advance notice.
  • 8b. You are advised that content may include technical inaccuracies or typographical errors. This is inevitable in any large website. We would be grateful if you bring errors to our immediate attention.
  • 8c. We give no warranty and make no representation, express or implied, as to:
    • • The adequacy or appropriateness of the goods for your purpose
    • • The truth of any content on our website published by someone other than us
    • • Any implied warranty or condition as to the fitness of the goods for a purpose other than that for which the goods are commonly used
  • 8d. Our website may contain links to other Internet websites outside of our power and control. You acknowledge and agree that we shall not be liable in any way for the content of any such linked website, nor for any loss or damage arising from your use of any such website.
  • 8e. To the maximum extent permitted by the Australian Consumer Law or by any other applicable law:-
    • (i) The Supplier disclaims all warranties with regard to the information and applications contained on the website and your use of the website, including all implied warranties of merchantability and fitness; and
    • (ii) The Supplier, its contractors, agents, or employees disclaim liability for any damages whatsoever (including special, indirect or consequential) arising out of or in connection with the use or performance of the website whether in contract, at common law or in equity, or on any other basis.


  • 9a. We are committed to compliance with the Privacy Act 1988 (as amended), the Australian Privacy Principles and all other privacy laws and guarantee that any personal information supplied to us will not be shared with any third party individual or organisation.
  • 9b. The personal information that is collected by the Supplier is limited to the name, address, contact details and particulars of firearms licences or permits that are supplied by you when you order products from us via this Website. We also keep records of your transactions and products ordered via the Website, and we provide records of firearms transactions to the relevant State or Territory authority in compliance with our legal obligations. We do not supply personal information to any private or public entities in any other country outside Australia.
  • 9c. This information is collected via the electronic order form and any other documents that are submitted by you in the course of this transaction.
  • 9c. This personal information is held securely on our web server, and is also backed up to other secure locations, including those operated by responsible third-party providers. We will ensure that your personal details remain secure at all times.
  • 9d. We retain this information to:-
    • (a) comply with all laws especially those pertaining to firearms transactions; and
    • (b) as your proof of purchase for any goods in relation to which you are entitled to warranty or technical support; and
    • (c) to enhance our customer service to you and to enable us to better respond to any inquiries from you regarding products that you order from us; and
    • (d) to enable us, where appropriate, to advise you of product enhancements, updates or of promotions or deals in relation to particular products or categories of products.
  • 9e. We do not retain credit card details or maintain records of any Customer’s credit card details.
  • 9f. Should you wish to obtain a copy, or to make any correction of your personal information in our possession, or if you have any complaint in relation to our handling of your personal information, please address your request in writing to the address set out below:-

  • 9g. We endeavour to respond to any privacy-related complaints within fourteen days of receipt. However, if you are unsatisfied with our response to your complaint, you are entitled to forward your complaint to the Office of the Australian Information Commissioner.   • 10a. We will defend the intellectual property rights in connection with our goods and our website whether provided by us or by any other content provider (including: text, graphics, logos, icons, images, audio clips, digital downloads, data, and software).
  • 10b. We also claim copyright in the designs and compilation of all content of our website.
  • 10c. You may not copy, modify, publish, transmit, transfer, sell, reproduce or distribute the content of our website.
  • 10d. All content is protected by Australian and international copyright laws.


  • When purchasing from us, card details are transmitted through a secure Westpac payment gateway. The Credit Card data is not recorded by us after processing.

      • 12a. Our website may contain reviews, comments, submissions or testimonials that have been submitted by customers either generally in relation to the Supplier or in relation to individual products. Except where otherwise indicated, such comments are attributable to the submitter alone and are not endorsed by the Supplier nor do they represent the views of the Supplier.
      • 12b. In making or submitting any reviews or comments via the Website, you agree:-
        • a) not to make remarks of an obscene, violent or threatening or defamatory nature. The Supplier may, in its unfettered discretion, remove or edit any submissions or comments that it deems to be inappropriate.
        • b) Not to breach copyright, trademark, or industrial design or privacy laws in making any submission.
      • 12c. By submitting any review, testimonial or commentary via the Website, you agree to assign the right to the Supplier to publish, republish, edit, and display your submission or commentary in any given medium in perpetuity.
